These Terms and Conditions govern the La Mer Hong Kong Miraculous Rewards (hereinafter called “Program”) operated by or on behalf of La Mer Hong Kong and our relationship with members of the Program (hereinafter called “Member”, “Members” or “You”). Membership in the Program is subject to these Terms and Conditions, which are the only terms and conditions that apply to the Program. By agreeing to join the Program, you agree that:
(a) you have read, understood and accepted these Terms and Conditions;
(b) you are eligible for membership;
(c) subject to clause 3 below, you consent to La Mer Hong Kong processing data that is personal to you.
1.1 After satisfying the Program entry criteria as determined at the sole discretion of La Mer Hong Kong, you will be invited to become a Member of the Program. The membership period is based on a fixed term for all Members and will be reviewed and renewed for the next term once renewal criteria are reached. Once you successfully join the Program, you will attain a Program membership with either your current La Mer VIP number or a new number assigned by La Mer Hong Kong. You will also receive details of the Program.
1.2 Membership is complimentary and is available only to individuals, not to companies, partnerships, associations, groups or other entities. You may not have more than one membership or any form of joint membership. La Mer Hong Kong may refuse membership without giving any reason.
1.3 Enrolment to the Program is on an individual basis and is open to individuals aged 18 or above. In respect of minors (individuals aged under 18), parental or legal guardian consent is required to join the Program.
1.4 Membership in the Program is not transferable and may only be used by the registered member. Membership numbers remain the property of La Mer Hong Kong and may be changed at any time or cancelled upon termination of the Program.
1.5 Unless otherwise stated, member benefits under the Program are subject to availability.
1.6 You may cancel your membership at any time with written notification and surrender your membership number. Upon receipt of your cancellation request, all membership entitlements will be foregone and cancelled. You may choose to remain in the La Mer database to continue receiving La Mer news and promotions other than those related to membership in the Program.
1.7 La Mer Hong Kong reserves the right to suspend, discontinue, or terminate the membership of any Member who is found to be using the Program in a manner inconsistent with the Terms and Conditions, or the intent of the Program or any portion of the Program. La Mer Hong Kong also reserves the right to discontinue membership for any Member who acts in a manner inconsistent with the spirit of the Program. Discontinued membership will result in the loss of all present and future benefits and privileges.
1.8 La Mer Hong Kong reserves the right to terminate the Program at any time.
1.9 La Mer Hong Kong reserves the right to add, modify, delete or otherwise change any of the terms, conditions, benefits and services pertaining to the Program at its sole discretion, at any time without prior notice to the Members.
1.10 La Mer Hong Kong’s interpretations of the Program’s Terms and Conditions shall be binding on the Members for all purposes and to all intents.
2 POINTS REDEMPTION
2.1 Members are entitled to accrue The Program’s Miracle Points (hereinafter called “Points”) for Hong Kong dollars spent at the Pacific Place, New Town Plaza, Vcity, K11 MUSEA, Harbour City Concept Stores, La Mer counters at Lane Crawford Canton Road, Lane Crawford IFC Mall, Lane Crawford Times Square, Harvey Nichols Landmark, Sogo Causeway Bay and Tsim Sha Tsui, Beauty Avenue Langham Place, Macau New Yaohan , Landmark North Pop-up Store (hereinafter called “Designated La Mer Counters”) and official site from July 1, 2021 to June 30, 2022 in the manner set out under Clauses 2.2 below or for participation in special promotions as determined by La Mer Hong Kong.
2.2 Members are entitled to accrue 10 Points for every 10 Hong Kong dollars spent at La Mer counters at Lane Crawford Canton Road, Lane Crawford ifc mall, Lane Crawford Times Square, Harvey Nichols Landmark, Sogo Causeway Bay and Tsim Sha Tsui, Beauty Avenue Langham Place, Macau New Yaohan and Landmark North Pop-up Store; or 15 Points for every 10 Hong Kong dollars spent at the Pacific Place, New Town Plaza, V city, K11 MUSEA, Harbour City Concept Stores and official site from July 1, 2021 to June 30, 2022.
2.3 The Points are valid from July 1, 2021 to June 30, 2022 for all Members and will expire and be forfeited after the period of validity.
2.4 The Points are not transferrable.
2.5 The Points are not exchangeable for cash, nor can they be used as cash. They can only be used for the redemption of the products/benefits/services listed in the Miraculous Rewards Brochure.
2.6 The list of products/benefits/services that may be redeemed using Points may be changed from time to time.
2.7 Redeemed products/benefits/services are not refundable, nor can they be exchanged. The products/benefits/services redeemed under the Program are for personal use only. Members may not sell or resell any such products/benefits/services. Violation of this term may result in the termination of membership.
2.8 Members shall make redemptions only at the Designated La Mer Counters in person using the Points accrued in his/her Membership account during redemption periods occurring on a quarterly basis as notified by La Mer Hong Kong or during seasonal promotions as otherwise designated by La Mer Hong Kong. Balance of unused Points will be carried forward until the Points expire.
2.9 La Mer Hong Kong is not responsible for lost, damaged, or stolen products or vouchers redeemed. Suspected illegal, fraudulent or other unauthorized use of La Mer Hong Kong issued products/benefits/services or any other activity inconsistent with these Terms and Conditions shall result in the termination of membership. La Mer Hong Kong reserves the right to audit membership accounts at any time.
2.10 The Points accrued from any purchased products that are returned or refunded by Member will be foregone and cancelled. The Member shall without limitation be liable to La Mer Hong Kong for the full price of the products/benefits/services redeemed from such cancelled points.
2.11 Points may take up to 6 weeks after the Member’s purchase or participation in special promotions to be credited to the Member’s account. Points are valid for the redemption of products/benefits/services as soon as they are credited to the Member’s account.
2.12 Gifts are in limited supply. Handling time may take up to 6 weeks. A substitute will apply if a gift is out of stock without further notice. Each Member is entitled to redeem at maximum two sets of each of The Revitalizing Journey which is redeemable using 85,000 Points, and Ultimate Skin Renewal which is redeemable using 125,000 Points, each of which contains six sessions of 45-minute The La Mer Custom Facial (hereinafter known as “The La Mer Skin Management System”) and other products/benefits/services as determined by La Mer Hong Kong. The Revitalizing Journey and Ultimate Skin Renewal are not redeemable at the New Town Plaza Concept Store, V city Concept Store, Sogo Causeway Bay and Tsim Sha Tsui counter or Beauty Avenue Langham Place counter. Members must complete all facial treatment sessions for The La Mer Skin Management System at the same La Mer counter/the Concept Store in which the redemption for the specific gift set is made. Redeeming Points for The La Mer Skin Management System is subject to capacity, which may affect the number of facial treatment services available for Members. Members acknowledge that La Mer Hong Kong reserves the right to offer facial treatment service bookings available at their sole discretion. In addition, La Mer Hong Kong may impose blackout periods without prior notice, during which The La Mer Skin Management System reward is not permitted. The redeemed series of facial treatment services must be completed within 9 months from the date of redemption.
2.13 Members can book their preferred time slot for the facial treatment service redeemed by Points prior to the preferred date. For telephone booking, the Member’s personal details must be verified in order to process a booking. Bookings will be processed on a first-come, first-served basis.
2.14 Members are entitled to extra Points for the first purchase during his/her birthday month. Members who spend HK$4,000 to $7,999, HK$8,000 to $11,999 and HK$12,000 or more will be entitled to 1,500 Points, 5,000 Points and 9,000 Points respectively in addition to the Points earned from the purchase of the product. The birthday offer can be enjoyed once a year only.
2.15 The La Mer Skin Management System is only available to female Members. Substitute gifts will be provided to male Members in lieu of The La Mer Skin Management System as determined by La Mer Hong Kong. La Mer Hong Kong reserves the right to decline any redemption request or booking for facial treatment services or any treatment in The La Mer Skin Management System based on the skin or health condition of Members without any liability or compensation from La Mer Hong Kong.
2.16 For those rewards that are manufactured or provided by third parties, La Mer Hong Kong excludes all liability in respect of their quality. In particular, La Mer Hong Kong does not warrant that any reward from third parties will be provided with reasonable care and skill.
2.17 Members should immediately report any suspected unauthorized redemption claims. La Mer Hong Kong will decide at its discretion what action, if any, will be taken. La Mer Hong Kong may refuse to credit Points to a Member’s account to compensate for any unauthorized redemption should the Member in any way contribute to the unauthorized redemption by negligence or otherwise. The sale or barter of Points and products/benefits/services redeemable is prohibited and will result in the forfeiture of all Points or rewards and the cancellation of membership. Violators will be liable for damages suffered or incurred by La Mer Hong Kong.
2.18 If there is any dispute between a Member and La Mer Hong Kong in relation to the Program’s Points redemption, the records kept in the Program system of La Mer Hong Kong shall be deemed as the conclusive evidence and the decision of La Mer Hong Kong shall be final.
3 DATA PRIVACY
3.1 La Mer Hong Kong intends to use the personal data provided by Members (including name, birthday, mobile or telephone number, email or residential or correspondence address) for the operation of the Program, delivery of associated benefits and services, Program development, direct marketing relating to the Program and its associated benefits and services, as well as direct marketing relating to skin care, cosmetics, beauty and accessory products and services, or those of a similar nature offered by La Mer Hong Kong and its affiliates, and to communicate news and information to Members for their benefit, and it intends to transfer such personal data to its affiliates, successors and business partners in other regions for the said purposes. La Mer Hong Kong may not use or transfer Members’ personal data without their written consent and Members hereby expressly agree that their personal data is provided voluntarily and it may be stored, transferred to, used, processed or held by La Mer Hong Kong and its affiliates, successors and business partners in other regions for the said purposes.
3.4 Members are responsible for keeping the Program up-to-date as to their correct communication/postal addresses.
Note: In the event of discrepancies between the English and Chinese versions of these Terms and Conditions, the English version shall apply and prevail.
